TERMS OF SERVICE

These Terms of Service govern purchases made through the GreenLeaf online store and the use of its related services. Please read them together with our Returns Policy and Privacy Policy.

Nothing in these Terms limits any mandatory rights that you have under applicable consumer law.

2. Scope and acceptance

These Terms apply to the EN-EU storefront, orders placed through it and any related customer-account functions. By submitting an order, you confirm that you have read these Terms and agree that they form part of the contract if GreenLeaf accepts your order.

A “consumer” is a natural person acting for purposes outside their trade, business, craft or profession. Provisions addressed specifically to consumers do not apply to business purchases, but business customers retain all rights that cannot lawfully be excluded.

You must be legally capable of entering into a binding contract. If you place an order for another person, you confirm that you are authorised to provide the necessary details and act on their behalf.


3. Product information and living plants

We take reasonable care to describe products accurately. Images, colours, dimensions and appearance may vary slightly because of screen settings, photography, seasonal development and the natural characteristics of living plants.

A live plant may naturally differ in height, shape, foliage density, flowering stage or colour from the example shown, provided that it remains the product ordered and conforms to the information and quality reasonably expected at the time of sale. Natural variation does not remove your rights where an item is damaged, incorrect or otherwise non-conforming.

Care instructions and suitability information are provided in good faith. Results may depend on climate, light, watering, soil, handling and other conditions outside our control. You remain responsible for choosing a product suitable for its intended location, without prejudice to our duty to provide accurate material information.

4. Prices, taxes and availability

Prices are displayed in the currency and with the taxes applicable to the market selected on the store. Delivery charges and any other order-specific cost are shown before you submit the order. You can review the total price before becoming bound to pay.

Products and offers are subject to availability. Placing an item in the cart does not reserve it. If an item becomes unavailable after you order, we will inform you without undue delay and refund any amount paid for that item.

If a price or product detail contains an obvious error that a reasonable customer should recognise, we may contact you to confirm the correct information or cancel the affected item and issue a prompt refund. This does not affect rights arising from a contract already validly concluded where the law requires otherwise.

5. Ordering and contract formation

  1. Select the products, quantities, delivery method and any available payment option.
  2. Review and correct your order and customer details before using the final order button, which indicates that the order carries an obligation to pay.
  3. Submitting the order is your offer to buy the listed products under these Terms.
  4. An automatic email confirming receipt of the order does not by itself mean that the order has been accepted.
  5. Our contract is formed when we expressly accept the order, including by confirming dispatch, unless applicable law provides an earlier point of formation.

We may decline or cancel an order before acceptance for reasons such as unavailability, unsuccessful payment authorisation, an obvious pricing error, legal or delivery restrictions, or a reasonable fraud or security concern. If payment has already been taken, we will refund it without undue delay.

The order confirmation and these Terms can be saved or printed. Order information is also sent to the email address you provide and may be available through your customer account.

6. Guest checkout and customer accounts

You may place an order as a guest without signing in or separately creating an account. Please provide complete, current and accurate contact, billing and delivery information.

Customer-account access is optional and passwordless. To sign in, enter the same email address used for your order and the one-time six-digit verification code sent to that address. Anyone who can access your email may be able to access your account, so you should keep your email account secure and notify us promptly if you suspect unauthorised use.

Using the same email address helps associate your orders with your customer profile. You are responsible for checking that your email address is correct before submitting an order.

7. Payment

The payment options currently available on the EN-EU storefront are:

  • PayPal; and
  • debit or credit card through Viva.com.

The options actually available to you and any related charge are displayed before you submit the order. Further practical information is available on our Payment Methods page. Payment services may be provided by third-party processors under their own terms and privacy notices.

You confirm that you are authorised to use the selected payment method. If a payment is declined or reversed, the order may be suspended or cancelled, without affecting any rights already accrued.

8. Delivery

Available destinations, delivery methods, estimated timings and charges are shown at checkout and on our Shipping Cost page. We aim to deliver without undue delay and, unless another period is agreed, no later than 30 days after the contract is concluded.

A valid mobile telephone number is required when placing an order. It is used to process the order and enable the courier to coordinate a correct delivery. Where necessary, the number is shared with the selected courier only for fulfilling the order, in accordance with our Privacy Policy.

Please ensure that the delivery address and contact details are accurate and arrange prompt receipt of parcels, particularly those containing living plants. If delivery fails because information supplied by you is incorrect or no one is available after reasonable delivery attempts, we may contact you about redelivery, collection or any reasonable additional cost actually incurred, where permitted by law. This does not remove your statutory rights or our responsibility for a breach attributable to GreenLeaf or its delivery partner.

For consumer orders, the risk of accidental loss or damage passes to you when you, or a person nominated by you other than the carrier, obtains physical possession of the goods. Different rules may apply only where you independently appoint a carrier not offered by GreenLeaf.

9. Cancellation requests before fulfilment

For an item that has not yet been fulfilled, you can submit a cancellation request through your customer account or contact us promptly. A request does not automatically cancel the order. We will review it and confirm whether cancellation has been completed.

Once an item has been fulfilled or dispatched, it can no longer be cancelled through the pre-fulfilment process. Any applicable withdrawal or return rights remain available under section 10 and our Returns Policy.

10. Withdrawal and returns

If you are an EU consumer and no statutory exception applies, you may withdraw from a distance purchase without giving a reason within 14 days from the day on which you, or a third party nominated by you other than the carrier, receives the goods. For goods delivered separately under one order, the period runs from receipt of the last item.

You may exercise this right by sending us a clear statement before the deadline, including through your customer account where the option is available, or by emailing info@green-leaf.gr. Full instructions are set out in our Returns Policy.

After notifying us, return the goods without undue delay and no later than 14 days from that notice. Unless the goods are faulty, incorrect or we agree otherwise, you bear the direct cost of return shipping. No restocking fee is charged for a valid statutory withdrawal. You may be responsible only for diminished value caused by handling beyond what is necessary to establish the goods' nature, characteristics and functioning.

We refund the eligible payments, including the cost of the least expensive standard delivery offered for the order, within 14 days after receiving your withdrawal notice. We may withhold reimbursement until we receive the goods or you provide evidence of having returned them, whichever occurs first. Refunds are made using the original payment method unless you expressly agree otherwise and incur no fee as a result.

Living plants: EU law excludes goods that are liable to deteriorate or expire rapidly from the right of withdrawal. This may apply to a particular live plant because of its characteristics or condition, but it is assessed case by case; GreenLeaf does not treat every live plant as automatically exempt. Any such exception does not affect your rights if the plant arrives damaged, is incorrect or does not conform to the contract.

11. Damaged, incorrect or non-conforming goods

Consumers benefit from the mandatory legal guarantee of conformity for at least two years from delivery. If goods do not conform to the contract, you may be entitled, under the applicable legal conditions, to have them brought into conformity by repair or replacement, or to receive an appropriate price reduction or terminate the contract.

These remedies are provided without charge where required by law. The nature and expected lifespan of a living plant, the condition in which it arrived, the care instructions supplied and subsequent growing conditions may be relevant to assessing conformity, but they do not remove statutory rights or legal presumptions.

Please contact us as soon as reasonably possible after discovering transit damage, an incorrect item or another problem, quoting the order number. Clear photographs of the parcel, packaging and product are strongly recommended because they help us assess and resolve the matter quickly. This practical request does not replace or shorten any mandatory statutory period, and an original paper receipt is not the only acceptable proof of purchase.

Where the problem is attributable to GreenLeaf or the goods are legally non-conforming, return or collection costs are handled as required by applicable law.

12. Promotions, discount codes and gift cards

Promotions, discount codes and gift cards may be subject to specific conditions disclosed when they are offered, including validity dates, eligible products, minimum spend and limits on combination. Unless stated otherwise, one promotion or code may be used per order.

Specific promotional conditions do not reduce mandatory consumer rights. If a promotion conflicts with these Terms, the specific promotion terms apply only to that promotion and only to the extent permitted by law.

13. Intellectual property

The store's design, text, photographs, graphics, logos, product materials and other content are owned by GreenLeaf or used with permission and are protected by applicable intellectual-property laws.

You may view and make a personal copy of store content for non-commercial shopping purposes. You may not reproduce, republish, distribute, modify, scrape, sell or commercially exploit it without prior written permission, except where the law expressly permits.

14. Acceptable use

You must not use the store or customer-account services:

  • for unlawful, fraudulent or misleading activity;
  • to interfere with security, availability or the proper operation of the store;
  • to introduce malicious code, attempt unauthorised access or collect data without a lawful basis;
  • to infringe another person's rights or submit false order, payment or contact information.

We may take proportionate steps to protect the store, customers and third parties, including restricting access or cancelling fraudulent orders, while respecting applicable law and existing consumer rights.

15. Third-party services and links

The store uses third-party services, including Shopify, payment providers, couriers and communication services, to process orders and operate the website. Their own terms or privacy notices may apply when you interact directly with them.

Links to third-party websites are provided for convenience or information. GreenLeaf does not control their content or availability and is not responsible for them except to the extent that applicable law assigns responsibility to us.

16. Privacy and communications

We process personal data to operate the store, fulfil orders, provide customer support, prevent fraud and meet legal obligations as described in our Privacy Policy. Cookie and consent choices are managed through the tools available on the website.

Operational messages concerning an order, payment, delivery, return or account security are not marketing communications. Marketing messages are sent only on the lawful basis described in the Privacy Policy, and you can unsubscribe at any time using the available link or settings.

17. Store availability and security

We use reasonable technical and organisational measures and reputable service providers to operate the store securely. No internet service can be guaranteed to be continuously available or completely free from error or security risk.

We may temporarily suspend or modify parts of the store for maintenance, security, legal or operational reasons. Where this materially affects an accepted order, we will take reasonable steps to inform you and provide the remedies required by law.

18. Liability

GreenLeaf is responsible for performing accepted orders and for loss or damage where responsibility arises under applicable law. We are not responsible for loss caused solely by inaccurate information supplied by the customer, misuse of a product, failure to follow material care instructions, or circumstances for which GreenLeaf is not legally responsible.

For consumers, nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence where applicable, breach of mandatory consumer rights, or damage for which the law provides a mandatory remedy.

Any limitation applicable to a business customer operates only to the maximum extent permitted by law and does not apply where exclusion would be unlawful.

19. Events outside reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, transport disruption, natural disaster, public-authority action, widespread service interruption or industrial action. We will take reasonable steps to reduce the effects, inform affected customers and resume performance. If the event causes a material delay, you retain any right to terminate and receive a refund that applicable law provides.

20. Changes to these Terms

We may update these Terms to reflect changes in law, store functions, payment or delivery methods and business practices. The revised version applies prospectively from the date shown at the top of the page.

The Terms in force when you place an order continue to govern that order, unless a change is required by law or you expressly agree otherwise. We will not retrospectively remove accrued rights.

21. Severability and no waiver

If a provision of these Terms is found invalid or unenforceable, it will be interpreted or removed only to the extent necessary, and the remaining provisions will continue to apply.

A delay by either party in enforcing a right does not waive that right.

22. Governing law and disputes

These Terms and contracts concluded through the store are governed by Greek law. If you are a consumer habitually resident in another country, this choice does not deprive you of the protection of mandatory provisions of the law of that country.

Any dispute may be brought before the courts that have jurisdiction under the applicable mandatory rules, including the consumer-jurisdiction rules that protect you in your country of residence where they apply.

Before starting formal proceedings, please contact us at info@green-leaf.gr with your order number and a clear description of the issue. We will try to respond and reach a fair solution without undue delay. This informal step does not restrict your right to use a competent court or alternative dispute-resolution body.
